Embezzlement draws nine month jail term
A Mariposa woman will spend nine months in county jail for two felony embezzlement cases against her. Marianne McNally was sentenced in Mariposa County Superior Court on May 20.
McNally had previously pleaded no contest in two separate cases. The first involved the Mariposa County High School Grizzly Hall of Fame account. She admitted to taking nearly $25,000 from the scholarship fund. The embezzlement occurred from July 2006 to May 2009, according to court records. She has since repaid it all.
The second case stemmed from her access to a class reunion account, in which she took about $1,400. That amount has also been repaid.
Deputy District Attorney Kim Fletcher argued that Mc- Nally should get a tough sentence. “The people feel the defendant should be sentenced to prison,” she said. Fletcher said McNally took advantage of a position of trust and of her employment at Yosemite Bank. “This was an egregious violation that affected children,” Fletcher said. “This was a high school scholarship trust fund. That’s an outrageous violation.”
Mariposa County Superior Court Judge Wayne Parrish sentenced McNally to 180 days in the Grizzly Scholarship case and another 90 days in the class reunion case. She was ordered to pay a $3,000 fine and must report to the jail on June 14.
District Attorney Bob Brown was not pleased with the court’s decision to give Mc- Nally local jail time. “The DA’s office always viewed this as a serious case and was unwilling to make any kind of deal on it,” Brown said following the hearing.
“I disagree with the probation recommendation and with the court’s sentencing,” Brown continued. “I believe it was an appropriate case for the defendant to be sent to prison. This woman harmed a lot of people in this community. I just don’t believe justice has been served.”
